Acceptance of Terms

Welcome to WiredWise. By accessing our website at wiredwise.co.ke or using our web development, graphic design, and IT services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use our services.

These Terms govern your use of WiredWise services. Our Privacy Policy explains how we collect and use information. By using our services, you agree to both these Terms and our Privacy Policy.

1. Services Description

What We Offer

WiredWise provides the following professional services:

Web Development

Custom website design and development
E-commerce solutions
Web application development
Website maintenance and support

Graphic Design

Logo and branding design
Marketing materials
UI/UX design
Print and digital assets

Service Limitations

We do not guarantee specific search engine rankings
Third-party services (hosting, domains) are subject to their own terms
Project timelines are estimates and may vary based on complexity
We reserve the right to refuse service to anyone

2. Project Agreements & Quotes

Project Initiation Process

Initial Consultation: Free discussion of your requirements
Proposal & Quote: Detailed scope and pricing
Contract Signing: Formal agreement with terms
Deposit Payment: Project commencement (typically 50%)
Project Kickoff: Timeline and milestone setup

3. Intellectual Property Rights

Ownership Transfer

Upon full payment of all fees, WiredWise transfers all intellectual property rights to you for:

Final website code and design
Graphic design source files (AI, PSD, etc.)
Custom developed software
All creative assets produced for your project

Client Responsibilities

Provide all necessary content, images, and brand assets
Obtain necessary licenses for third-party content
Review and approve work at each milestone
Provide timely feedback (within 5 business days)

What We Retain

Right to display completed work in our portfolio
Non-exclusive license to use for marketing purposes
Development frameworks and proprietary code libraries
Backup copies for 12 months for support purposes

4. Web Development Specific Terms

Hosting & Domains

Domain Registration: We assist with registration but domains are registered in your name. You own the domain.
Hosting Services: We recommend hosting providers but you are responsible for hosting fees and terms.
SSL Certificates: We install SSL certificates but renewal is your responsibility.
Backups: We perform regular backups during development. Post-launch backup responsibility depends on hosting arrangement.

Basic training on content management
Documentation delivery

Additional Support

Monthly maintenance plans available
Hourly support rates apply
Emergency support (additional fee)

5. Revisions & Change Requests

Web Design

3 design revisions included

Logo Design

3 concept revisions included

Development

2 rounds of functional revisions

Change Request Policy

Additional revisions billed at hourly rate: KES 2,500/hour
Major scope changes require new quote and may affect timeline
Change requests must be submitted in writing
We will provide time/cost estimate for significant changes

6. Project Cancellation & Refunds

Project Pause & Resumption

Projects can be paused for up to 30 days at no additional cost
Pauses beyond 30 days may incur restart fees
All project materials are archived during pause
Pause requests must be submitted in writing

7. Warranties & Liability

Our Warranties

Work will be professional and of high quality
Websites will function on major browsers (Chrome, Firefox, Safari, Edge)
Code will be valid and follow current web standards
We will use reasonable skill and care in providing services

Limitations of Liability

We are not liable for third-party service failures (hosting, domains, etc.)
Maximum liability limited to total project fees paid
Not liable for indirect, consequential, or incidental damages
Not liable for business losses or lost profits
Not responsible for content accuracy provided by client

Indemnification

You agree to indemnify and hold harmless WiredWise from any claims arising from:

Your use of our services
Your violation of these Terms
Content you provide for your project
Infringement of third-party rights by your materials

8. General Terms

Governing Law

These Terms are governed by Kenyan law. Any disputes shall be resolved in courts in Thika, Kenya.

Force Majeure

Not liable for delays due to circumstances beyond our control (natural disasters, strikes, etc.).

Modifications to Terms

We may update these Terms at any time. Continued use of our services after changes constitutes acceptance.
